1. Acceptance of Terms

By accessing or using any service operated by EVO Networks LLC ("EVO Networks," "we," "us," or "our"), including but not limited to our website at evo-networks.us, our game servers, our Discord community, or any products or services offered through these platforms, you ("User," "you," or "your") agree to be legally bound by these Terms of Service ("Terms").

These Terms constitute a binding legal agreement between you and EVO Networks LLC ("EVO Networks LLC"), a limited liability company registered in the United States. If you are using our services on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. About EVO Networks

EVO Networks LLC is a gaming community organization that operates multiplayer game servers across multiple titles including, but not limited to, S&box, Rust, and Minecraft. We provide community-driven gaming experiences, custom game modifications, and supporting services through our website and affiliated platforms.

EVO Networks is not affiliated with, endorsed by, or sponsored by any game developer, publisher, or platform holder whose games we host servers for, including but not limited to Valve Corporation, Facepunch Studios, or Mojang Studios.

3. Eligibility

You must be at least 13 years of age to use our services. If you are under 18 years of age, you must have the consent of a parent or legal guardian to make any purchases. By making a purchase, you represent that you are either 18 years of age or older, or that you have obtained parental or guardian consent.

You must have a valid Steam account to authenticate on our website. By using Steam OpenID authentication, you also agree to Steam's Subscriber Agreement and applicable Valve terms.

4. User Accounts & Authentication

Steam Authentication

Our website uses Steam OpenID for authentication. We do not store your Steam password. By logging in through Steam, you authorize us to access your Steam profile information including your Steam ID, display name, and avatar for the purpose of identifying you on our platform.

Account Responsibility

You are solely responsible for all activity that occurs through your account. You agree to notify us immediately of any unauthorized use of your account. EVO Networks will not be liable for any loss resulting from unauthorized use of your account.

Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or our community rules, with or without notice. Upon termination, your right to use our services ceases immediately and any purchased virtual items or benefits may be forfeited without refund.

5. Game Servers & Community Rules

Access to our game servers is provided as a service and is not guaranteed. We reserve the right to modify, suspend, or shut down any server at any time without notice or compensation.

All players on EVO Networks game servers are subject to our server-specific rules, which are posted on our website and in-game. Violations of server rules may result in warnings, temporary bans, or permanent bans at our sole discretion.

Purchasing a rank or donating to EVO Networks does not exempt you from following server rules. Purchased benefits may be revoked without refund if you are banned for rule violations.

We make no guarantee of uptime, availability, or continuity of any game server. Servers may be taken offline for maintenance, updates, or any other reason at any time.

6. Purchases, Donations & Virtual Goods

Nature of Purchases

All purchases made through EVO Networks, including server ranks, titles, cosmetics, and other in-game benefits ("Virtual Goods"), are for digital services only. Virtual Goods have no real-world monetary value and cannot be exchanged, transferred, or redeemed for real money, cryptocurrency, or any other tangible asset.

Donations

Donations made to EVO Networks are voluntary contributions to support server operations, development, and community growth. In appreciation of donations, donors may receive certain in-game benefits and Discord roles. These benefits are provided as a courtesy and do not constitute a contractual obligation.

Subscriptions

Server ranks, titles, and certain other Virtual Goods are offered on a recurring monthly subscription basis. Your subscription will automatically renew each month until cancelled. You may cancel at any time through the account panel on our website (available on the Store and Donate pages while logged in) or by emailing billing@evo-networks.us. Upon cancellation, your benefits remain active until the end of the current billing period. No partial refunds will be issued for unused subscription time.

Rank Upgrades

Only one rank subscription may be active per account at a time. You may upgrade to a higher rank at any time; upon completing an upgrade purchase, your previous rank subscription will automatically stop renewing and will expire at the end of its already-paid billing period. No refund, credit, or proration is provided for the remaining time on a replaced rank. Purchasing the same or a lower rank while a rank subscription is active is not permitted.

Failed Renewal Payments

If a subscription renewal payment fails, the payment processor may retry the charge. If payment cannot be collected, the subscription will be cancelled and associated benefits will be removed without further notice.

Pricing

We reserve the right to change the pricing of Virtual Goods and subscriptions at any time. Price changes will not affect the renewal price of a subscription that is already active at the time of the change; new pricing applies to new purchases.

Custom Titles & User-Submitted Content

Custom title text submitted at checkout is subject to our community rules and the Prohibited Conduct section of these Terms. We reserve the right to reject, modify, or remove any custom title that we determine, in our sole discretion, to be offensive, misleading, impersonating, or otherwise inappropriate, without refund.

Multi-Server Purchases

Purchases made for a specific game server apply only to that server unless explicitly stated otherwise. Benefits do not automatically transfer across different game servers operated by EVO Networks.

Payment Processing

Payments are processed by third-party payment processors including Stripe and NowPayments. By making a purchase, you also agree to the applicable terms and privacy policies of these payment processors. EVO Networks does not store your payment card or banking information.

Cryptocurrency Payments

Cryptocurrency payments are processed through NowPayments. Cryptocurrency transactions are irreversible by nature. The value of cryptocurrency can fluctuate significantly. EVO Networks is not responsible for exchange rate changes or network fees associated with cryptocurrency transactions.

7. Refund Policy

By completing a purchase, you explicitly acknowledge and agree that:

• All sales are final and non-refundable
• Virtual Goods are delivered immediately upon payment confirmation and cannot be returned
• Subscription cancellations take effect at the end of the current billing period with no partial refunds
• Bans or account terminations resulting from rule violations do not entitle you to a refund
• Server downtime, modifications, or discontinuation do not entitle you to a refund
• Cryptocurrency donations and payments are irreversible and non-refundable by nature

In the event of a duplicate charge or billing error made solely by EVO Networks, we will investigate and resolve the issue at our discretion. Please contact us within 7 days of the transaction.

8. Chargebacks & Disputes

By making a purchase, you agree to contact EVO Networks directly to resolve any billing issues before initiating a chargeback or payment dispute with your bank or payment processor.

Initiating an unauthorized chargeback or payment dispute constitutes a material breach of these Terms and will result in the immediate and permanent termination of your account and all associated benefits without refund. We reserve the right to contest any chargeback and provide evidence of service delivery to payment processors.

Users found to have initiated fraudulent chargebacks may be reported to relevant authorities and payment processors and may be permanently banned from all EVO Networks services.

9. Prohibited Conduct

You agree not to engage in any of the following while using EVO Networks services:

• Cheating, hacking, exploiting bugs, or using unauthorized third-party software on any game server
• Harassment, hate speech, discrimination, or threats against any user or staff member
• Attempting to disrupt, crash, or DDoS any EVO Networks server or service
• Impersonating EVO Networks staff or other players
• Sharing, selling, or transferring your account or purchased benefits to others
• Purchasing benefits with stolen payment methods or fraudulent accounts
• Attempting to circumvent any ban or account suspension using alternate accounts
• Engaging in any activity that violates applicable local, state, federal, or international laws
• Attempting to reverse engineer, decompile, or extract any EVO Networks custom addons or code

10. Third-Party Platform

EVO Networks operates its S&box roleplay server using the DXRP gamemode platform, developed and owned by Dxura. EVO Networks LLC is an independent community server operator and is not affiliated with, endorsed by, or in partnership with Dxura or the DXRP project.

DXRP and all associated software, assets, and intellectual property remain the exclusive property of Dxura. EVO Networks LLC makes no claim of ownership over the DXRP platform or any of its components.

Additionally, EVO Networks LLC is not affiliated with Facepunch Studios (developers of s&box), Valve Corporation, or any other game developer or publisher whose platforms or games are used in connection with our servers.

By using our services you also agree to comply with the applicable terms of service of any third-party platforms used to access our servers, including but not limited to the s&box platform terms and Steam Subscriber Agreement.

11. Intellectual Property

All original content on evo-networks.us, including website design, graphics, text, custom game addons, and branding, is the property of EVO Networks LLC and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from EVO Networks content without express written permission from EVO Networks LLC.

Third-party game assets, trademarks, and intellectual property referenced on this site remain the property of their respective owners.

12. Disclaimers & Limitation of Liability

EVO NETWORKS SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVO NETWORKS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, EVEN IF EVO NETWORKS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL EVO NETWORKS LLC'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO EVO NETWORKS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless EVO Networks LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of our services, your violation of these Terms, or your violation of any rights of another person or entity.

14. Termination

EVO Networks reserves the right to suspend or terminate your access to any or all of our services at any time, with or without cause, with or without notice, and without liability to you. Upon termination, all licenses and rights granted to you under these Terms will immediately cease.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Governing Law

These Terms shall be governed by and construed in accordance with the applicable laws of the United States, without regard to conflict of law provisions. You agree that any dispute arising from or relating to these Terms or our services will first be attempted to be resolved through good faith negotiation between the parties.

If a dispute cannot be resolved through negotiation, both parties agree to resolve the dispute through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except where prohibited by applicable law. Nothing in this section prevents either party from seeking injunctive or other equitable relief for violations of intellectual property rights or unauthorized access to services.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Changes to These Terms

EVO Networks LLC reserves the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, posting a notice on our website or Discord server.

Your continued use of our services after any changes to these Terms constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
